Terms and conditions

1. Scope and contracting party

These terms apply to all contracts concluded by consumers (Section 13 BGB, German Civil Code) with us via the online shop at mevapatisserie.de. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession.

2. Formation of the contract

The products shown in our online shop do not constitute a legally binding offer but an invitation to place an order. By clicking the "Buy now" button in the final step of checkout, you make a binding offer to purchase the goods in your cart.

Before submitting, you can review and correct your entries at any time using your browser's back function or the edit links in the cart. Once your order reaches us, you will receive an automatic email confirming receipt (order acknowledgement). This does not yet constitute acceptance of your order.

The purchase contract is concluded when we accept your order by a separate order confirmation email or dispatch the goods, whichever comes first. For payment by credit card, PayPal, Apple Pay or Klarna, the contract is concluded as soon as the payment provider confirms the payment instruction.

The contract language is German; this English version is provided for convenience and the German version prevails. We store the contract text and send you the order details and these terms by email. Registered customers can also view their orders in their account.

3. Prices and shipping costs

All prices are final prices in euros and include statutory VAT. Lokum is a foodstuff and is subject to the reduced German VAT rate of 7%.

Shipping costs are charged in addition and shown during checkout before you place the order. Standard shipping within Germany costs €4.90; orders of €49 or more ship free within Germany. Shipping to other EU countries costs €9.90. Full details are on our shipping page.

4. Payment

We accept the following payment methods: credit card (Visa, Mastercard), Apple Pay, PayPal and Klarna. Payments are processed by the respective payment provider, whose terms of use also apply.

The purchase price is due on conclusion of the contract. For credit card and Apple Pay, your account is charged when the order is completed. For Klarna, the payment terms offered by Klarna apply.

If you order with a discount code, it can be redeemed only once per customer, cannot be combined with other promotions and cannot be exchanged for cash.

5. Delivery

We deliver to Germany and to the following countries: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Greece, Hungary, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden. Orders are shipped with DHL.

Delivery takes 2 to 3 working days within Germany and 3 to 6 working days to the other delivery countries, counted from receipt of payment. Orders received by 12 noon on a working day usually leave our workshop the same day.

If not all ordered products are immediately available, we may make partial deliveries where this is reasonable for you. You will not be charged any additional shipping costs for this.

If an ordered product is permanently unavailable, we will inform you without delay and refund any payments already made.

6. Retention of title

The goods remain our property until paid in full.

7. Right of withdrawal

As a consumer you have a statutory right of withdrawal of 14 days. You will find the details, the exceptions for opened food products and the model withdrawal form in our withdrawal policy.

8. Shelf life, storage and warranty

Lokum is a fresh foodstuff without artificial preservatives or colouring. The best-before date is printed on every box. Store the boxes in a cool, dry place away from direct sunlight, and enjoy soon after opening. Ingredients and allergens are listed on the product page and on the packaging.

Statutory warranty rights apply. If a delivery arrives damaged or defective, please contact us promptly at [email protected], ideally with a photo. We will replace the goods or refund the purchase price.

9. Gift service

On request we gift-wrap your order, add a handwritten card with your message and ship it directly to the recipient. In that case the invoice is not included in the parcel; we send it to you by email. As the purchaser, you remain our contracting party, and the right of withdrawal belongs to you, not to the recipient.

10. Liability

We are liable without limitation for intent and gross negligence and for damage resulting from injury to life, body or health. In cases of slight negligence we are liable only for breach of an essential contractual obligation, limited to the foreseeable damage typical for the contract. Liability under the German Product Liability Act remains unaffected.

11. Dispute resolution

We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 VSBG, German law). For any questions or complaints you can reach us at any time at [email protected].

12. Final provisions

The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you habitually reside in another EU country, the mandatory consumer protection provisions of that country remain unaffected.

If any provision of these terms is invalid, the remainder of the contract remains valid.
